Terms of Service (ToS)

The DTB User Service Agreement and Privacy Policies are also collectively known as “Terms
of Service” (ToS). By clicking “Continue” during the registration process you conclude a
legally binding agreement with the owners and operators of Defend The Border website, also
collectively referred to as (DTB), including but not just subject to, mobile application,
developer platform, premium services or other information provides by DTB.

If you are using DTB on behalf of a company or other legal entity, you are still individually
bound by this User Service Agreement, even if your company has a separate
contract/service agreement with DTB.

By Joining the DTB Site, you hereby acknowledge that you have read and understood the
terms and conditions of this User Service Agreement and that you agree to be bound by all
of its provisions. Therefore, you also consent to use electronic signatures and acknowledge
your decision to join DTB.

Requirements and Commitments

Applicable laws and the User Service Agreement

In entering into this User Service Agreement you have agreed to comply with all applicable
laws, the User Service Agreement may be updated to comply with changes in

DTB Policy Guidelines with or without advance notification. The following Policies and
Procedures are explained in the following sections of the Terms of Service

(ToS), derives from Defend The Border Website (DTB) Principles, and is our terms of service
that governs our relationship with users and others who interact with DTB.

Privacy

We value your privacy. We designed our ToS and referred Data Usage Policy to make
important information updates about how you can use DTB to share with others and how we
collect and can use your content and information.

Distribution of Your Content and Information

DTB values your ownership to all of the content and information you post on DTB, and you
can control how it is shared through your privacy and application settings. In addition:

Sharing Personal Information

This is the information that your friends, non-friends, pages, etc. see on DTB see about you.
This can be but not limited to: profile and your status updates, discussions on DTB. You can
update your personal information at any time.

For content that is covered by intellectual property rights, like photos and videos (IP
content), you specifically give us the following permission, subject to your privacy and
application settings: you grant us a non-exclusive, transferable, sub-licensable, royalty-free,
worldwide license to use any IP content that you post on or in connection with DTB (IP
License). This IP License ends when you delete your IP content or your account unless your
content has been shared with others, and they have not deleted it.

DELETED IP CONTENT

When you delete IP content, it is deleted in a manner similar to emptying the recycle bin on
a computer. However, you understand that removed content may persist in backup copies
for a reasonable period of time (but will not be available to others).

When you use an application, the application may ask for your permission to access your
content and information as well as content and information that others have shared with
you. We require applications to respect your privacy, and your agreement with that
application will control how the application can use, store, and transfer that content and
information.

When you share news, videos, audios, or images (i.e., publish content, information) using
DTB website, it means that you are allowing everyone, including people off of DTB, to access
and use that information, and to associate it with you (i.e., your name and profile picture).

We appreciate your feedback and suggestions about DTB, but please understand that we
may use them without any obligation to compensate you for them.

DTB Rights to Ownership in and to the Site and Services

DTB reserves the right, other than User Content, we own or license all right, and possession
of title, and interest in and to (a) the Site and Services, including all software, text, media,
ratings, reviews and other content available on the Site and Services (“DTB Content”); and
(b) DTB’s trademarks, logos, and brand elements (“Marks”). The Site and Services, DTB
content, and Marks are all protected under U.S. and international laws.

Other Provisions

Where in: under no circumstances will DTB be held liable for any delay or failure in
performance due in whole or in part to any acts of nature or other causes beyond its
reasonable control.

Security and Protection

We care about your security and protection and uphold to keep DTB safe, however, we
cannot guarantee it. We need your help to keep DTB safe, which includes the following
commitments by you:

(A.) You will not post unauthorized commercial communications (such as spam) is strictly
prohibited on DTB.

(B.) You will not collect users’ content or information, or otherwise access DTB, using
automated means (such as harvesting bots, robots, spiders, or scrapers) without our prior
permission.

(C.) Engaging in unlawful multi-level marketing, such as a pyramid scheme, is strictly
prohibited.

(D.) The uploading of viruses or other malicious code is strictly prohibited.

(E.) You will not solicit login information or access an account belonging to someone else.

(F.) You will not bully, intimidate, or harass any user; violations could result in account
restrictions, account banning, civil and or criminal charges.

(F.1) DTB will not tolerate extreme hate speech or the calling for violence against a race,
religion, or person which includes but is not limited to: calling for the murder of,
encouraging or admitting to illegal activity, etc. This will result in your immediate removal
from DTB and could be subject to criminal penalties through the due process of law.

(F.2) Any and all posting of pornography in any form will result in the immediate removal of
your account.

(F.3) The Threat of or calling for any violence or armed aggression, towards any State, or
Federal Official or Agency is strictly prohibited. DTB will not tolerate any of these types of
posts or messages. These acts will result in the immediate banning or your account and
possible criminal punishment.

(F.4) You will not post content that: is threatening to a person or group; is pornographic
material; incites violence; contains nudity; contains graphic images of gratuitous violence;
depicts any human or animal suffering, torture, or death; is deemed illegal. Violation of
these terms could lead to the restricting, banning, or deletion of your account, and might
possibly include criminal prosecution.

Exception: Some highly graphical images that have political value, may be allowed with our
“Mature Content” cover. This image posting exception will be determined at the sole
discretion of our staff, on the individual assessment of each image.

(F.5) Any character maligning, malicious/derogatory attack(s), perpetuated by any DTB
member against another DTB member or group (on, or outside of DTB) is strictly prohibited
and could result in a warning, account restriction, or possible account termination based on
the severity of the attack.

(F.6) If your account has been banned, and you wish to appeal, please email
banned@defendtheborder.org.

(G.) Promotions Guidelines will be adhered to and all applicable laws if you publicize or offer
any contest, giveaway, or sweepstakes (promotion and design) on DTB.

(H.) You agree you will not use DTB to do anything unlawful, misleading, malicious, or
discriminatory.

(I.) You agree not participate in any attempts to: disable, overburden, or impair the proper
working or appearance of DTB, such as: (DDoS) a denial of service attack or interference
with page rendering or other DTB functionality.

(J.) You will not attempt to thwart any technological measure implemented by DTB or any of
Defend The Border’s providers or any other third party (including another user) to protect
the Site or Services.

(K.) You will not attempt to decipher, decompile, disassemble, or reverse-engineer any of
the software used to provide the Site or Services.

(O.) You will not facilitate or encourage any violations of this User Service Statement or our
policies.

Registration and Account Security

We request that all DTB users provide their real names and information. This info will assist
us with verifying account ownership pertaining to requests for account recoveries, or
reinstatements.

Here are some commitments you can make to help us maintain the security of your DTB
account:

You will not create an account for anyone other than yourself without permission.

You will not create more than one personal account.

If we disable your account, you will not create another one without our express permission.

You will not use your personal timeline for your own commercial gain (such as selling your
status update to an advertiser).

Registered Users have to be of the age of 13 to access DTB.

Convicted Sex Offenders are not allowed to participate on DTB.

You will keep your contact information accurate and up-to-date.

You will not share your password (or in the case of developers, your secret key), let anyone
else access your account, or do anything else that might jeopardize the security of your
account.

You will not transfer your account (including any Page or application) to anyone without first
getting our written permission.

If you select a username or similar identifier for your account or page, we reserve the right
to remove or reclaim it if we believe it is appropriate (such as when a trademark owner
complains about a username that does not closely relate to a user’s actual name).

Personal profiles and fan/group pages that are created and use a famous name or brand are
subject to deletion at our discretion.

These famous persons/brands profiles or pages must be verified with proper documentation
by DTB. To verify your personal or business, you can send us a copy of an

official ID for personal accounts or official business filing paperwork for
business/organization. Please send to DTB@defendtheborder.org

Protecting Other People’s Rights

We respect other people’s rights and expect you to do the same.

You will not post content or take any action on DTB that infringes or violates someone else’s
rights or otherwise violates the law.

We can remove any content or information you post on DTB if we believe that it violates this
ToS or our policies.

We provide you with tools to help you protect your intellectual property rights. To report an
Intellectual Property Infringement, email us at info@defendtheborder.org.

If we remove your content for infringing someone else’s copyright, and you believe we
removed it by mistake, we will provide you with an opportunity to appeal.

If you repeatedly infringe other people’s intellectual property rights, we will disable your
account when appropriate.

You will not use our copyrights or trademarks (including Defend The Border, the
defendtheborder.org/com Logos, or any confusingly similar marks, except as expressly
permitted by our Brand Usage Guidelines or with our prior written permission.

If you collect information from users, you will: obtain their consent, make it clear you (and
not Defend The Border nor the defendtheborder.org website) are the one collecting their
information and post a privacy policy explaining what information you collect and how you
will use it.

The posting of anyone’s identification documents or sensitive financial information on DTB is
strictly prohibited.

Conditions For Use

You agree to abide by all applicable local, state, national and international laws and
regulations and are solely responsible for all acts or omissions that occur under your account
made by you by joining DTB and are held by the bounds of the ToS and the User Service
Agreement.

Mobile and Other Devices

We currently provide our mobile services for free, but please take note: your carrier’s
normal rates and fees, such as text messaging fees, will still apply.

In the event you change or deactivate your mobile telephone number, you will update your
account information on DTB within 48 hours to ensure that your messages are not sent to
the person who acquires your old number.

You agree to provide consent and all rights necessary to enable users to sync (including
through an application) their devices with any information that is visible to them on DTB.

Payments

If you make a payment on Defend The Border Website or use Defend The Border Website
Credits, you agree to our Payments Terms presented at the time of payment checkout.

Indemnity

By accepting these Terms of Service/User Service Agreement, you agree to indemnify and
otherwise hold harmless DTB, its officers, employees, agents, subsidiaries, affiliates and
other partners from any direct, indirect, incidental, special, consequential or exemplary
damages resulting from: (your use of DTB unauthorized access to or alteration of your
communications with or through DTB) any other matter relating to DTB.

YOU AGREE TO INDEMNIFY AND HOLD DTB AND ITS SHAREHOLDERS, SUBSIDIARIES,
AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CO-BRANDERS AND OTHER
PARTNERS, HARMLESS

FROM ANY CLAIM OR DEMAND, INCLUDING ANY ATTORNEYS’ FEES, DTB (OR THE OTHER
INDEMNITEES) MAY INCUR RESULTING FROM OR ARISING OUT OF YOUR ACTIONS AND/OR
ANY CONTENT YOU

SUBMIT, POST, TRANSMIT OR MAKE AVAILABLE THROUGH THE SERVICE, YOUR ACCESS
AND USE OF THE SERVICE, YOUR CONNECTION TO THE SERVICE, YOUR VIOLATION OF THE
TOS/CSA, OR

YOUR VIOLATION OF ANY RIGHTS OF ANOTHER. YOU FURTHER AGREE TO INDEMNIFY AND
HOLD DTB AND ITS SHAREHOLDERS, SUBSIDIARIES, AFFILIATES, DIRECTORS, OFFICERS,
EMPLOYEES,

AGENTS, CO-BRANDERS AND OTHER PARTNERS, HARMLESS FROM ANY CLAIM OR DEMAND,
INCLUDING ANY ATTORNEYS’ FEES, DTB (OR THE OTHER INDEMNITEES) MAY INCUR
RESULTING FROM OR

ARISING OUT OF YOUR USE OR TRANSMISSION OF OTHER MEMBERS. CONTENT IN
CONNECTION WITH PROMOTIONAL TOOLS AND PROMOTIONAL CAMPAIGNS MADE
AVAILABLE BY DTB.

You expressly understand and agree that we shall not be liable for any direct, indirect,
incidental, special, consequential, or exemplary damages, including but not limited to,
damages for loss of profits, goodwill, use, data or other intangible losses (even if we have
been advised of the possibility of such damages). Some jurisdictions do not allow the
exclusion of liability for incidental or consequential damages. Accordingly, some of the above
limitations may not apply to you. In no event will our total cumulative liability exceed US
$10.00.

Special Provisions Applicable to Social Plugins

If you include our Social Plugins, such as the Share or Like buttons on your website, the
following additional terms apply to you:

We give you permission to use DTB’s Social Plugins so that users can post links or content
from your website on DTB. You give us permission to use and allow others to use such links
and content on DTB. You will not place a Social Plugin on any page containing content that
would violate this ToS/CSA Statement if posted on DTB.

Special Provisions Applicable to Developers/Operators of Applications and Websites:

If you are a developer or operator of a Platform application or website, the following
additional terms apply to you

You are responsible for your application and its content and all uses you make of Platform.
This includes ensuring your application or use of Platform meets our DTB Platform Policies
and our Advertising Guidelines set here in.

Your access to and use of data you receive from DTB will be limited as follows:

You will only request data you need to operate your application.

You will have a privacy policy that tells users what user data you are going to use and how
you will use, display, share, or transfer that data and you will include your privacy policy
URL in the Developer Application.

You will not use, display, share or transfer a user’s data in a manner inconsistent with your
privacy policy.

You will delete all data you receive from us concerning a user if the user asks you to do so,
and will provide a mechanism for users to make such a request.

You will not include data you receive from us concerning a user in any advertising creative.

You will not directly or indirectly transfer any data you receive from us to (or use such data
in connection with) any ad network, ad exchange, data broker, or other advertising related
toolset, even if a user consents to that transfer or use.

You cannot and will not sell user data. If you are acquired by or merge with a third party,
you can continue to use user data within your application, but you cannot transfer user data
outside of your application.

We can require you to delete user data if you use it in a way that we determine is
inconsistent with users’ expectations.

We can limit your access to data.

You will comply with all other restrictions contained in our DTB Platform Policies.

You will not give us information that you independently collect from a user or a user’s
content without that user’s consent.

You will provide an easy solution to make it easy for users to remove or disconnect from
your application.

You agree that you will not show third party ads or web search boxes on DTB.

We give you all rights necessary to use the code, APIs, data, and tools you receive from us.

You agree that you will not sell, transfer, or sublicense our code, APIs, or tools to anyone.

You will not misrepresent your relationship with DTB to others.

You may use the logos we make available to developers or issue a press release or other
public statement so long as you follow our DTB Platform Policies.

We can issue a press release describing our relationship with you.

You will comply with all applicable laws. In particular, you will (if applicable):

Policies are in place for removing infringing content and terminating repeat infringers in
compliance with the Digital Millennium Copyright Act.

We comply with the Video Privacy Protection Act (VPPA), and obtain any opt-in consent
necessary from users so that user data subject to the VPPA may be shared on DTB.

You represent that any disclosure to us will not be incidental to the ordinary course of your
business.

You give us all rights necessary to enable your application to work with DTB, including the
right to incorporate content and information you provide to us into

streams, timelines, and user action stories that however can include status updates and
posts.

You give us the right to link to or frame your application, and place content, including ads,
around your application.

We can analyze your application, content, and data for any purpose, including commercial
(such as for targeting the delivery of advertisements and indexing content for search).

To ensure your application is safe for users, we can audit it.

We can create applications that offer similar features and services to, or otherwise compete
with, your application.

About Advertisements and Other Commercial Content Served or Enhanced by DTB:

At DTB we strive to deliver ads and commercial content that are valuable to our users and
advertisers. In order to help us do that, you agree to the following:

You can use your privacy settings to limit how your name and profile picture may be
associated with commercial, sponsored, or related content (such as a brand you like) served
or enhanced by us. You give us permission to use your name and profile picture in
connection with that content, subject to the limits you place.

We do not give your content or information to advertisers without your consent.

You understand that we may not always identify paid services and communications as such.

Special Provisions Applicable to Advertisers (advertising opportunities coming soon)

You can target your desired audience by buying ads on DTB or our publisher network. The
following additional terms apply to you if you place an order through our online advertising
portal.

(Order): When you place an Order, you will tell us the type of advertising you want to buy,
the amount you want to spend, and your bid. If we accept your Order, we will deliver your
ads as inventory becomes available. When serving your ad, we do our best to deliver the
ads to the audience you specify, although we cannot guarantee in every instance that your
ad will reach its intended target.

In instances where we believe doing so will enhance the effectiveness of your advertising
campaign, we may broaden the targeting criteria you may specify.

You will pay for your Orders in accordance with our Payments Terms. The amount you owe
will be calculated based on our tracking mechanisms.

Your ads will comply with our Advertising Guidelines.

We will determine the size, placement, and positioning of your ads.

We do not guarantee the activity that your ads will receive, such as the number of clicks
your ads will get.

We cannot control how clicks are generated on your ads. We have systems that attempt to
detect and filter certain click activity, but we are not responsible for click fraud,
technological issues, or other potentially invalid click activity that may affect the cost of
running ads.

You can cancel your Order at any time through our online portal, but it may take up to 24
hours before the ad stops running. You are responsible for paying for all ads that run.

Our license to run your ad will end when we have completed your Order. You understand,
however, that if users have interacted with your ad, your ad may remain until the users
delete it.

We can use your ads and related content and information for marketing or promotional
purposes.

You will not issue any press release or make public statements about your relationship with
DTB without our prior written permission.

We may reject or remove any ad for any reason.

If you are placing ads on someone else’s behalf, you must have permission to place those
ads, including the following:

You warrant that you have the legal authority to bind the advertiser to this ToS/ User
Service Agreement Statement.

You agree that if the advertiser you represent violates this Statement, we may hold you
responsible for that violation.

Special Provisions Applicable to Software

If you download our software, such as a stand-alone software product or a browser plugin,
you agree that from time to time, the software may download upgrades, updates and
additional features from us in order to improve, enhance and further develop the software.

In addition, you agree that you will not modify, create derivative works of, decompile or
otherwise attempt to extract source code from us, unless you are expressly permitted to do
so under an open source license or we give you express written permission.

Amendments

We can change this ToS/User Service Agreement Statement and will provide you notice as a
site wide notification or internal message.

For changes to sections (sections relating to payments, application developers, website
operators, and advertisers), we will give you a minimum of three days’ notice for all other
changes. We will send out a site wide notification within 48 hours of making ToS
Modifications.

We can make changes for legal or administrative reasons, or to correct an inaccurate
statement.

Your continued use of DTB as set forth in this ToS/User Service Agreement Statement
following changes to our terms constitutes your acceptance of our amended terms.

Termination

If you violate the letter or spirit of this ToS/User Service Agreement Statement or otherwise
create risk or possible legal exposure for us, we can stop providing all or part of DTB

Services to you. We will notify you by email or at the next time, you attempt to access your
account. You may also delete your account or disable your application at any time.

Disputes

You will resolve any claim, cause of action or dispute (claim) you have with us arising out of
or relating to this ToS/User Service Agreement Statement or DTB exclusively in a state or
federal court located in Florida. The laws of the State of Florida will govern this ToS/User
Service Agreement Statement, as well as any claim that might arise between you and DTB,
without regard to conflict of law provisions. You agree to submit to the personal jurisdiction
of the courts located in Florida for the purpose of litigating all such claims.

If anyone brings a claim against us related to your actions, content or information on DTB,
you will indemnify and hold us harmless from and against all damages, losses, and expenses
of any kind (including reasonable legal fees and costs) related to such claim. Although we
provide rules for user conduct, we do not control or direct users’ actions on DTB and are not
responsible for the content or information users transmit or share on DTB. We are not
responsible for any offensive, inappropriate, obscene, and unlawful or otherwise
objectionable content or information you may encounter on DTB. We are not responsible for
the conduct, whether online or offline or any user of DTB.

DISCLAIMER OF WARRANTIES

YOU ACKNOWLEDGE AND AGREE THAT:

YOUR USE OF THE SERVICE IS AT YOUR SOLE OWN RISK. THE SERVICE IS PROVIDED ON
AN “AS IS” AND “AS AVAILABLE” BASIS. DTB EXPRESSLY DISCLAIMS ALL WARRANTIES OF
ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE
IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND
NON-INFRINGEMENT.

DTB MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii)
THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE
RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR
RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER

MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR
EXPECTATIONS, AND (v) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.

ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE
SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK. YOU WILL BE SOLELY
RESPONSIBLE FOR ANY DAMAGE TO YOUR OR OTHERS. COMPUTER SYSTEM OR LOSS OF
DATA THAT RESULTS, DIRECTLY OR INDIRECTLY, FROM THE DOWNLOAD OF ANY SUCH
MATERIAL. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY
YOU FROM DTB OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT
EXPRESSLY STATED IN THE TOS/USER SERVICE AGREEMENT. YOU ACKNOWLEDGE
AND AGREE THAT DTB USES COMMERCIALLY REASONABLE EFFORTS TO PROTECT ITS
MEMBERS, BUT THAT DTB DOES NOT GUARANTEE THAT THE USE OF THE SERVICE WILL BE
SAFE OR SECURE.

NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, AND TO THE
EXTENT THAT A JUDGMENT IS RENDERED IN A COURT OF COMPETENT JURISDICTION
DISREGARDING ONE OR MORE OF THE WARRANTY DISCLAIMER AND LIABILITY
LIMITATION COVENANTS CONTAINED HEREIN, DTB’S AGGREGATE LIABILITY TO YOU SHALL
NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU
HAVE PAID DTB IN THE PAST TWELVE MONTHS.

LIMITATION OF LIABILITY

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT DTB SHALL NOT BE LIABLE TO YOU FOR
ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR
EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF
PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLES (EVEN IF DTB HAS BEEN
ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR
THE INABILITY TO USE THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE
GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES
PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO
THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF
YOUR CONTENT, TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY
THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE.

OTHER DTB MEMBERS, WITH WHOM YOU CHOOSE TO ASSOCIATE, CONNECT, INTERACT
AND/OR SHARE CONTENT AND COULD USE YOUR CONTENT AND/OR LIKENESS IN A
MANNER YOU DISLIKE, DISAPPROVE OF OR OTHERWISE FIND OFFENSIVE. HOWEVER, YOU
AGREE NOT TO ASSERT ANY CLAIMS, ACTIONS OR DEMANDS AGAINST DTB IN
CONNECTION WITH SUCH USE OR ACTIVITIES, WHETHER SUCH USE OR ACTIVITIES ARE
AUTHORIZED BY THESE TOS/CSA OR NOT.

EXCLUSIONS AND LIMITATIONS

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE
LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL

Special Provisions Applicable to Users Outside the United States:

We strive to create a community with consistent standards for everyone, but we also strive
to respect local laws. The following provisions apply to users and non-users who interact
with DTB outside the United States:

You consent to have your personal data transferred to and processed in the United States.

If you are located in a country embargoed by the United States or are on the U.S. Treasury
Department’s list of Specially Designated Nationals you will not engage in commercial
activities on DTB (such as advertising or payments) or operate a Platform application or
website.

Definitions

Defend The Border refers to the features and services we make available, including through
(a) our website at www.defendtheborder.org and any other DTB branded or co-branded
websites (including sub-domains, international versions, widgets, and mobile versions); (b)
our Platform; (c) social plugins, and other similar offerings and (d) other media, software
(such as a toolbar), devices, or networks now existing or later developed.

Platform: refers to a set of APIs and services (such as content) that enable others, including
application developers and website operators, to retrieve data from DTB or provide data to
us.

Information: Facts and other information about you, including actions taken by users and
non-users who interact with DTB.

Content: refers to anything you or other users post on DTB that would not be included in the
definition of information.

Data: and or user data, user’s data we mean any data, including a user’s content or
information that you or third parties can retrieve from DTB or provide to DTB through
Platform.

Posts: referring to Posts on DTB, we or otherwise made available by using DTB.

Use: refers to any copy, publicly perform or display, distribute, modify, translate, and create
derivative works of.

Active Registered User: refers to a user who has logged into DTB at least once in the
previous 30 days.

Application: Any application or website that uses or accesses Platform, as well as anything
else that receives or has received data from us. If you no longer access to our Platform but
have not deleted all data from us, the term application will apply until you delete the data.

Other

If you are a resident of or have your principal place of business in the US or Canada, this
Statement is an agreement between you and DTB, Otherwise, this Statement is an
agreement between you and DTB. ToS/User Service Agreement Statement references to
“us,” “we,” and “our” meaning Defend The Border as appropriate.

This ToS/User Service Agreement makes up the entire agreement between the parties of
user and site provider regarding DTB, and supersedes any prior agreements.

If any portion of this ToS/User Service Agreement Statement is found to be unenforceable,
the remaining portion will remain in full force and effect.

If we fail to enforce any of this ToS/User Service Agreement, it will not be considered a
waiver.

Any amendment to or waiver of this Statement must be made in writing and signed by us.

You will not transfer any of your rights or obligations under this ToS/User Service
Agreement to anyone else without our consent.

All of our rights and obligations under this Statement are freely assignable by us in
connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise.

Nothing in this Statement shall prevent us from complying with the law.

This Statement does not confer any third party beneficiary rights.

We reserve all rights not expressly granted to you.

You will comply with all applicable laws both international and national when using or
accessing DTB.

Your Consent

By using our site, you consent to our ToS and User Agreement Service Statement terms as

Changes to our terms of service

We reserve the right to update our terms of service at our sole discretion and without prior
notice. We will, however, post a side wide notification of any ToS changes on the date said
